Terms of Service
The agreement between your business and MapleChat.

These terms govern your use of MapleChat. By creating an account you accept them on behalf of the business you represent, and you confirm you are authorised to do so.
What MapleChat provides
MapleChat is software that connects to your own WhatsApp Business Account and lets your team manage conversations and automate replies. We provide the software and the infrastructure it runs on. We do not provide the messaging channel itself — that is Meta's WhatsApp Business Platform, and your use of it is governed by your agreement with Meta.
Your WhatsApp Business Account is yours
This is central to how MapleChat works and how it is priced.
You register and own your WhatsApp Business Account. Meta bills you directly, at Meta's published rates, for the conversations you have. We do not resell messaging and we do not add a per-message markup. MapleChat charges only its own platform fee, according to the plan you choose.
Because the account is yours, you are responsible for meeting Meta's requirements for it, including its business and commerce policies, message template rules and quality ratings. If Meta restricts or removes your account, MapleChat cannot restore it, and your subscription remains payable.
Your responsibilities
You are responsible for the messages you send and the automations you build. In particular:
- You must have a lawful basis to message every contact, and you must honour opt-outs.
- You must comply with Meta's policies and with the marketing, privacy and consumer-protection law that applies to you.
- You must keep your team's credentials secure and remove access promptly when people leave.
- You must not use MapleChat for the activities described in Acceptable Use.
You are the controller of your customers' data. We process it on your instructions, under the Data Processing Addendum.
Plans, billing and trials
New accounts begin with a free trial. At the end of it, continued use requires a paid plan. Fees are stated at the time you subscribe, are billed in advance, and are non-refundable except where the law requires otherwise or where we have failed to provide the service.
Features vary by plan. We may change plan contents and pricing with reasonable notice; changes take effect at your next renewal, and you may cancel before then.
Meta's conversation charges are separate and are never invoiced by us.
Availability
We aim to keep MapleChat available and will give advance notice of planned maintenance where we can. We do not guarantee uninterrupted service, and parts of the service depend on Meta's platform, which is outside our control.
Suspension
We may suspend an account that is materially in breach of these terms, that puts the platform or other customers at risk, or that we are legally required to suspend. Where circumstances allow, we will warn you first and give you an opportunity to fix the problem.
Intellectual property
We keep all rights in the MapleChat software, brand and documentation. You keep all rights in your data and your content. You grant us only the licence needed to operate the service for you — hosting, transmitting, backing up and displaying your data — and nothing more.
Liability
To the extent the law allows, neither party is liable for indirect or consequential loss, lost profits, or lost business. Our total liability in any twelve-month period is limited to the fees you paid us during that period. Nothing here excludes liability that cannot lawfully be excluded.
Termination
You may cancel at any time; your subscription runs to the end of the paid period. We may terminate for material breach that is not remedied after notice. On termination your data is deleted per Data Deletion.
Changes
We may update these terms. Material changes will be notified to account owners in advance. Continuing to use MapleChat after they take effect means you accept them.
Governing law
MapleChat is operated by PhiLogic Technologies LLP (LLPIN ADA-0679), a limited liability partnership registered in India at 250 KVA Golapora, Magam, Chadoora Police Station, Budgam 193401, Jammu & Kashmir.
Governing law and the forum for disputes are stated in the order form or, where none exists, these terms are governed by the laws of India and subject to the exclusive jurisdiction of the courts at Srinagar, Jammu & Kashmir.
